1. Acceptance of Terms

By accessing or using MoodCanvas ("Service") at moodcanvas.in, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years old to use MoodCanvas. By using the Service, you represent that you meet this age requirement. Users under 18 should have parental consent.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorised use of your account at [email protected].
• One person may not maintain more than one free account.

4. Subscription Plans & Payments

4.1 Plans

MoodCanvas offers three subscription tiers:

• Free: 5 canvases per month, basic mood detection.
• Vibe+ (₹99/month): 20 canvases per month, all 6 context signals, taste profile personalisation.
• Canvas Pro (₹249/month): 100 canvases per month, Deep Vibe Match, storyline analysis.

4.2 Billing

Paid subscriptions are billed monthly in advance in Indian Rupees (INR) via Razorpay. By subscribing, you authorise us to charge your payment method on a recurring monthly basis.

4.3 Cancellation & Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until then. We do not offer pro-rated refunds for partial months, except where required by applicable law.

4.4 Quota Limits

Canvas generation and Deep Vibe Match quotas reset on the 1st of each calendar month. Unused quota does not carry over. We reserve the right to adjust quota limits with reasonable notice.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, scrape, or extract data from the Service in bulk.
• Use automated bots or scripts to generate canvases or circumvent quota limits.
• Share your account credentials with others to circumvent subscription limits.
• Attempt to gain unauthorised access to other users' accounts or our systems.
• Upload or transmit malicious code, viruses, or harmful content.
• Impersonate any person or entity.

6. Intellectual Property

The MoodCanvas name, logo, design, and original content are owned by MoodCanvas and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Content recommended by MoodCanvas (videos, music, movies, podcasts) is owned by their respective rights holders. MoodCanvas does not claim ownership of third-party content.

7. Third-Party Services

MoodCanvas integrates with third-party services including YouTube, Spotify, IMDb/OMDb, OpenAI, and Razorpay. Your use of content or features powered by these services is also subject to their respective terms of service. We are not responsible for the availability, accuracy, or content of third-party services.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that recommendations will meet your expectations. AI-generated recommendations are for entertainment purposes and may not always be accurate or appropriate.

9. Limitation of Liability

To the maximum extent permitted by applicable law, MoodCanvas shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of India.
